So You Got Served — Now What?

By: Janice Dantes

Being served with legal papers can feel overwhelming, stressful, and even intimidating. Whether the documents involve a divorce, custody matter, lawsuit, restraining order, or another legal issue, it’s important to remember that being “served” does not automatically mean you have lost your case. It simply means that a legal action has been filed and you are being formally notified so you have the opportunity to respond.

One of the biggest mistakes people make after being served is ignoring the paperwork. Many hope the issue will simply go away on its own, but failing to respond can lead to serious consequences, including default judgments, court orders being granted without your input, wage garnishments, or other legal penalties. Taking action early gives you the best opportunity to protect your rights and understand your options moving forward. The first thing you should do is carefully review the documents you received. Pay close attention to deadlines, hearing dates, and any instructions included in the paperwork. Court documents often contain strict timelines, and missing a deadline can negatively affect your case. Even if you do not fully understand the legal language, do not set the documents aside.

Here are a few important things to remember after being served:

• Stay calm and do not panic

• Read all documents carefully

• Take note of response deadlines and court dates

• Avoid contacting the other party in anger or frustration

• Gather important records, messages, or evidence related to the case

• Speak with an attorney as soon as possible

It is also important to avoid relying solely on advice from friends, social media, or online forums. Every case is different, and legal situations often involve details that can significantly affect the outcome. Speaking with a qualified attorney can help you better understand what the documents mean, what your responsibilities are, and what steps you should take next.

In some cases, there may be opportunities to resolve the matter outside of court through negotiation or settlement discussions. In other situations, it may be necessary to formally respond and prepare for hearings or litigation. Either way, responding promptly and staying informed can make a major difference in how your case progresses.
